Our Fees

We aim to provide a high quality, value for money service with no hidden extras or fees and will discuss the cost of funding your case with you at our first meeting to make sure you always know what is required of you and what to expect from us.


Commercial Debt Recovery Service

The first stage of the process is to send a letter before action. On average, 85% of cases result in payment at the letter before action stage. If payment is not received, you can continue by issuing legal proceedings, obtaining a County Court Judgment (CCJ) and commencing enforcement action. Alternatively, insolvency action can also be taken against a debtor.

To begin the debt collection process where the debtor is a limited company or a firm (partnership) we can send either a Letter Before Action to the debtor, which requests payment from the debtor within seven days or alternatively a Late Payment Demand, which not only claims your basic debt but also claims interest, compensation and your reasonable debt collection costs under the Late Payment of Commercial Debts (Interest) Act 1998, provided both parties were acting in the course of business.

Letter Before Action and Late Payment Demands are sent by first class post to safeguard your costs however you can send a copy of the letter via email.

To begin the debt collection process where the debtor is an individual the new Pre-Action Protocol for Debt Claims is applicable from 01 October 2017. It will only affect you when your debtor is an individual.

Our charge is £15.00 plus VAT and is applicable to letters containing up to 16 printed sheets of A4 paper and postage. When the letter contains between 17 and 50 printed sheets the actual additional postage will be charged in addition to the £15.00 plus VAT.

50 printed sheets is the maximum we will include in a Pre-action Protocol letter (Pre-action Protocol letter can only be sent by first class post) - Please note that if the debt is paid at this stage you will not be charged any of the costs or fees.

Issuing legal proceedings

We issue all debt recovery claims up to £100,000 via Money Claim Online (MCOL), the online court service for claimants and defendants. This offers clients cheaper court fees than issuing in the normal county court.

The table below shows the MCOL court fees and our fixed, solicitors' costs, both of which are recoverable if the debtor then goes on to pay the claim without dispute. These costs include us completing and submitting the claim form and the particulars of claim.

Additional costs

For claims exceeding £100,000 and/or if the claim is particularly complex; or preparation time might be lengthy, we may charge an additional fee.

On all defended actions our terms of engagement will be sent to you which give full details of our retainer and charges. We will endeavour to claim compensation and interest under the Late Payment of Commercial Debts (Interest) Act 1998 where this is possible and appropriate.

Disbursements (not included in costs set out above)

Disbursements are costs that are payable to third parties, such as visa fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

We will normally be able to submit most types of application within 10 working days of instruction provided we have received all the necessary documentation.

We cannot guarantee how long the Home Office will take to process your application. However, the current processing times can be found on the Home Office website.

All applications are likely to vary and of course, we can give you a more accurate estimate once we have more information about your specific case.


Personal Injury & Medical Negligence Service

For Personal Injury & Medical Negligence cases we offer our specialist services on a No win, No fee basis which means we will only charge for our services if we/you win your case and you will not have to pay us if your claim is unsuccessful.

If your claim is successful, then an agreed percentage of your compensation award will go towards paying for our service. The majority of personal injury and medical negligence claims we deal with will be on a no win, no fee basis.

A No Win No Fee agreement covers you from having to pay your legal fees should you lose your case. This means in the event that you did lose your case, you would not be charged. When funding your case through a No Win No Fee agreement, we take out an insurance policy known as After the Event insurance (ATE) on your behalf to cover any additional costs, such as court fees. If you did lose your case, you wouldn't have to pay the premium of this policy.

An exception to this rule would be if the court decided that you had acted dishonestly in making the claim and if you are found in breach of your agreement. In this case, you might be liable to pay our costs. This will be made clear to you when you start your claim, however please check this with your solicitor if you need any further clarification.


Our Complaints Procedure

If you wish to make a formal complaint, which could include a complaint about our level of service, you are kindly requested to make it in writing to Mr Shahzad Aslam, the Director of Redburn Solicitors at Dunham House, 1st Floor, Cross Street, Sale, Cheshire M33 7HH.

On receipt of your complaint we will write to notify you of how the complaint will be handled and within what timescales you will be given an initial or substantive response. We also have a complaints procedure, a copy of which is available on request.

On occasions, we may invite you to attend a meeting to explain the outcome of our internal investigation in more detail, in an effort to ensure that you will receive an adequate summary of the steps taken to resolve any problems.
